Rules for MG Foundation Queen of Hearts Raffle

The MG Foundation Queen of Hearts Raffle is being conducted by the Morton Grove Foundation (“MG Foundation”), a not-for-profit 501c3 organization pursuant to the Illinois Raffles Act, 230 ILCS 15/0.01 et seq., and the Morton Grove Municipal Code. All proceeds raised by the Raffle will benefit MG Foundation in fulfillment of its charitable missions. The Raffle Official Rules and Regulations (“Official Rules”) are set forth below. By purchasing a Raffle ticket (“Ticket”), the purchasers acknowledge that they are aware of, and agree to be bound by, these Official Rules as interpreted by the MG Foundation which shall be solely responsible for interpreting and applying the Official Rules. MG Foundation’s interpretation and application of such rules shall be final.

Ticket Sales

1. Participants must be at least 18 years old to play and do not have to be present to win.

2. Tickets may be purchased at locations designated on the Morton Grove Foundations website: mortongrovgfoundation.org. No mail, phone orders or internet sales are allowed and all sales of tickets are final.

3. Ticket prices are $5.00 each, and participants can buy as many tickets as they want, subject to availability. Tickets must be paid for in cash.

4. On each Ticket, the participant writes his/her full name (to match driver’s license or valid id) and phone number along with a number between 1-54.

5. Ticket sales for each raffle begin one hour after the prior raffle’s drawing is complete if the queen of hearts is not picked and run until 30 minutes before the drawing for that raffle.

6. Entries which are illegible, have been or appear to be altered are void.  All contact information shall be legible on the Ticket including full name (no nicknames, abbreviations, or group names) and phone number.  Only one person’s name may be entered on a Ticket. If the name of more than one (1) person is provided on a Ticket and that Ticket is selected as the winning Ticket, then the person listed first will be deemed as the holder of record of that Ticket and declared the winner. The division of any prize among a group of persons purchasing a Ticket shall be the sole responsibility of the person named as the holder of record of that Ticket should that Ticket be selected as a winner. MG Foundation is not responsible for resolving any disputes that may arise from different individuals listed on a winning Ticket. Neither MG Foundation nor its directors, officers, employees, agents or other representatives assume any responsibility or liability for lost, late, misdirected, mutilated, incomplete, illegible or undelivered Tickets, or any other failure to receive Tickets, or any failure to deliver a Ticket prior to the drawing deadlines.

Raffle Board and Drawing

7. All 54 cards (including two jokers) are placed randomly behind 54 numbers on a factory sealed board. The board is kept in a locked case at all times except during weekly drawings.

8. Sold Tickets are placed in a bin.

9. Unless notified otherwise on the MG Foundation’s website page, weekly drawings are held at 9:00 p.m. every Wednesday at Moretti’s Ristorante & Pizzeria, 6415 Dempster Street, Morton Grove, IL 60053. Drawings will be in public.

10. At the drawing, one Ticket is drawn from the bin.

11. The name and number on the Ticket is read, and then the corresponding numbered card from the raffle board is revealed.

12. If a number is not listed on the Ticket, or if a number selected in a previous raffle is listed on the Ticket, the Ticket shall be deemed invalid and a new Ticket shall be drawn.

13. If the revealed card is not queen of hearts, the holder of record of the Ticket wins a designated prize and the pot rolls over for next week’s raffle. The pot continues to roll over each week until the queen of hearts is revealed.

14. If the revealed card is the queen of hearts, the pot is divided as follows:

15. First the expenses of the raffle (including without limitation the costs to purchase Boards bins and supplies, print tickets and advertise the raffle) will be deducted. The remainder of the pot is the “Net Pot”

16. The holder of record of the Ticket wins 50% of the Net Pot or $1,000 whichever is greater.

17. The MG Foundation receives 40% of the Net Pot, and

18. 10% of the Net Pot shall be used to start the pot for the next raffle, provided the MG Foundation chooses to continue the raffle, otherwise said 10% shall be retained by the MG Foundation.

19. Each week after the drawing, all purchased Tickets, except for the winning Ticket will be destroyed, and new Tickets will be sold for the next weekly drawing.

Claiming a Prize

20. The card number and the name of the holder of record of the winning Ticket (“the Potential Winner”) shall be announced at the drawing and shall be posted on the MG Foundation’s website and Facebook Page. The MG Foundation shall attempt to contact the Potential Winner by calling the phone number on the Ticket.

21. The Potential Winner must claim his/her prize within 30 days of the drawing. If a Potential Winner does not claim his/her prize within 30 days of the drawing, or if the prize cannot be awarded for any other reason, the prize shall be forfeited and the prize shall become the property of the MG Foundation. MG Foundation will have the sole discretion to determine whether the Potential Winner is eligible to be the winner of the prize in accordance with these Official Rules (the “Official Winner”).  As a condition of his/her right to collect a Prize and become an Official Winner, any Potential Winner must deliver to MG Foundation: (a) the Ticket receipt and/or proof of identity in forms satisfactory to MG Foundation showing that the person claiming the prize is the holder of record of the winning Ticket; (b) such written information as is required by any applicable tax and/or other laws, including, without limitation, Social Security Number; (c) if required by law,  a completed IRS Form W-2G, Illinois Form 5754 or similar tax form (provided by MG Foundation) for tax withholding purposes which must be completed and received by the MG Foundation before the prize will be paid.

22. Non-Deductibility of Ticket Purchase: The IRS has taken the position that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts, and consequently, the purchase of a Ticket does not qualify as a deductible charitable contribution.

23. All winners are solely responsible for the payment of any and all taxes. The Official Winner may be required to pay withholding tax in an amount required by IRS regulations and IDOR.

24. The MG Foundation shall withhold a portion of the prize as required by the IRS, federal or state law.

25. Prize amounts will be paid by check.

Terms and Conditions:

26. MG Foundation reserves the right to amend these Official Rules upon ten (10) days’ notice provided pursuant to an update provided on MG Foundation’s website or otherwise posted at the event location.

27. These Official Rules cannot be changed by any oral statement made by any person acting on behalf of MG Foundation. By entering the Raffle, each Raffle participant accepts and agrees that MG Foundation may use the Raffle Participant’s name, photograph, likeness, statements, or voice for promotional or advertising purposes in all forms of media, now or hereafter known, in perpetuity, without review, permission or further compensation, except where prohibited by law.

Cancellation/Termination of Raffle:

28. By purchasing a Ticket and choosing to participate in the Raffle, each Raffle participant acknowledges and agrees that MG Foundation has the right, in its sole discretion, to elect not to proceed with the Raffle for any reason whatsoever or for no reason.  In such an event MG Foundation will conduct one final drawing in which Tickets will be drawn until the Queen of Hearts location is determined on the board.
